REFUND POLICY
1. INTRODUCTION
This Refund Policy ("Policy") governs refund requests for services provided by NESTIFYTECH SOLUTIONS PRIVATE LIMITED ("Nestifytech Solutions India") and NESTIFYTECH SOLUTIONS LLC ("Nestifytech Solutions US") (collectively referred to as "Nestifytech Solutions," "we," "us," or "our").

Given the bespoke nature of our services, refunds are not automatically available once work has commenced. Each refund request will be evaluated on a case-by-case basis in accordance with this Policy.

Refunds may be considered in the following circumstances:
Service Non-Delivery:
We fail to commence agreed services within the timeline specified in the service agreement
We are unable to deliver services due to circumstances within our control
Material Breach by Nestifytech Solutions:
We materially breach the terms of our service agreement
We fail to perform services in accordance with agreed specifications and industry standards
Technical Impossibility:
After commencement, it becomes technically impossible to deliver the agreed services due to unforeseen technical limitations
Such impossibility must be documented and verified by our technical team
3.2 Non-Eligible Scenarios
Refunds will NOT be provided in the following circumstances:
Client-Initiated Changes:
Changes in project scope, requirements, or specifications requested by the client
Client decides to cancel or terminate services for reasons unrelated to our performance
External Factors:
Third-party service failures or limitations beyond our control
Changes in client's business circumstances, priorities, or budget
Force majeure events as defined in our Terms of Use
Completed Work:
Services that have been substantially completed and delivered
Work products that have been accepted by the client
Services where deliverables have been provided and are functional
Consulting and Advisory Services:
Time spent on consulting, planning, or advisory services
Knowledge transfer and training sessions already conducted
4. REFUND PROCESS AND TIMELINE
4.1 Refund Request Procedure
To request a refund, you must:
Submit Written Request: Send a detailed refund request to info@nestifytech.com within 30 days of the issue arising
Provide Documentation: Include relevant service agreements, communications, and supporting documentation
Specify Grounds: Clearly state the specific grounds for the refund request under this Policy

Upon receiving a refund request:

5. REFUND CALCULATION METHOD

We are entirely at fault for non-delivery
Services are cancelled within 48 hours of agreement execution (subject to terms)
5.2 Partial Refunds
Partial refunds will be calculated based on:
Milestone-Based Projects: Refund for uncompleted milestones minus any work-in-progress
Time-Based Projects: Refund for remaining contracted hours minus hours already utilized
Fixed-Price Projects: Proportional refund based on percentage of work not completed
5.3 Deductions
Any refund amount may be reduced by:
Third-party costs already incurred and non-recoverable
Administrative and processing fees (maximum 5% of refund amount)
Work products or services already delivered and accepted
6. SPECIAL CONDITIONS FOR DIFFERENT SERVICES
6.1 Custom Software Development
Refunds considered only for undelivered features or modules
Code and development work already completed remains our intellectual property until full payment
No refunds for debugging or maintenance of delivered software
6.2 Digital Transformation Consulting
No refunds for strategic advice, recommendations, or consulting time already provided
Refunds may apply to undelivered implementation phases
6.3 Cloud Services and Infrastructure
No refunds for third-party cloud service costs already incurred
Setup and configuration work completed is non-refundable
Ongoing service credits may be provided instead of cash refunds
6.4 Data Analytics and AI Solutions
No refunds for data analysis and insights already provided
Model development work completed is non-refundable
Refunds may apply to undelivered dashboard or reporting components
7. ALTERNATIVE REMEDIES
Before requesting a refund, we encourage clients to consider alternative remedies:
7.1 Service Credits
Credits toward future services of equivalent value
Extended service periods or additional features at no extra cost
7.2 Project Modifications
Adjustment of project scope to match budget constraints
Reallocation of resources to different project components
7.3 Timeline Extensions
Extended project timelines to ensure quality delivery
Phased delivery approach to manage costs and expectations
8. REFUND METHODS AND PROCESSING
8.1 Refund Methods
Refunds will be processed using the same payment method used for the original transaction:
Bank transfers for wire payments
Credit card refunds for card payments
Check payments for original check transactions
8.2 Processing Timeline
Credit Card Refunds: 5-10 business days
Bank Transfers: 7-15 business days
International Transfers: 10-20 business days
Check Payments: 15-30 business days
8.3 Currency and Exchange Rates
Refunds will be processed in the original payment currency
Exchange rate fluctuations are not our responsibility
Any bank or processing fees will be deducted from the refund amount
9. DISPUTE RESOLUTION
